This notice explains how personal information is collected, used, shared and protected when you engage with Nishimoto Southern Africa.

1. Who is responsible for your information

Nishimoto Southern Africa is the regional commercialisation, customer-support and distribution platform for Nishimoto Lubricants. The South African responsible party for this website is EBK Distributors (Pty) Ltd, acting as Nishimoto’s Southern African representative and distribution partner.

2. Information we may collect

  • Identity and contact information such as your name, organisation, role, telephone number and email address.
  • Enquiry, distributor-application, technical-support and product-interest information.
  • Commercial information supplied during quotations, customer onboarding, supplier engagement or partnership discussions.
  • Technical information such as IP address, device, browser, referral source and consent preferences where generated by the website or hosting platform.
  • Correspondence, call notes and records required to manage our relationship with you.

3. How information is collected

Information may be collected directly from you through website forms, email, telephone, WhatsApp, meetings and applications; from your organisation or authorised representative; from publicly available business sources; and automatically through essential website and security technology.

4. Why we process information

  • To respond to product, catalogue, technical-support and general enquiries.
  • To evaluate distributor, customer, supplier and commercial-partner applications.
  • To prepare quotations, manage orders, provide services and administer commercial relationships.
  • To comply with legal, tax, customs, regulatory, accounting, warranty and record-keeping obligations.
  • To secure, troubleshoot, measure and improve the website and our services.
  • To communicate relevant business or product information where permitted by law or where valid consent has been given.
  • To establish, exercise or defend legal rights.

5. Lawful processing

We process personal information where it is necessary to conclude or perform a contract, comply with a legal obligation, protect a legitimate interest, pursue our legitimate business interests in a proportionate manner, or where you have given voluntary and informed consent. Consent may be withdrawn at any time without affecting prior lawful processing.

6. Sharing of information

Information may be shared on a need-to-know basis with Nishimoto group or brand stakeholders, authorised distributors, professional advisers, financial institutions, insurers, logistics and customs providers, IT and cloud providers, website hosting and form-processing providers, regulators, law-enforcement bodies and other parties required to fulfil your request or comply with law. We do not sell personal information.

7. Cross-border processing

Because this is a regional and international brand platform, limited information may be processed or stored outside South Africa, including through cloud, email, website-hosting or principal-support services. We take reasonably practicable steps to ensure that cross-border processing is subject to appropriate contractual, legal or organisational safeguards consistent with section 72 of POPIA.

8. Retention

Personal information is retained only for as long as reasonably necessary for the purpose collected, the duration of a business relationship, applicable warranty or dispute periods, and legal or regulatory retention requirements. Information that is no longer required is securely deleted, destroyed or de-identified where reasonably practicable.

9. Security

We apply reasonable technical and organisational safeguards appropriate to the nature of the information and the risks involved. No internet transmission or storage environment is completely secure; therefore absolute security cannot be guaranteed.

10. Your rights

Subject to POPIA and PAIA, you may request access to personal information, ask for inaccurate information to be corrected or deleted, object to particular processing, withdraw consent, request evidence of authorisation, or lodge a complaint. We may require proof of identity before acting on a request.

11. Direct marketing

Electronic direct marketing will be sent only where permitted by POPIA. Every marketing communication will provide a reasonable way to opt out. Service, transactional, safety, product-support and relationship communications are not necessarily marketing communications.

12. Children

This website is intended for business and adult users. We do not knowingly solicit personal information from children without lawful authority or the consent of a competent person.

14. Updates

We may update this notice to reflect operational, legal or technology changes. The effective date and version at the top indicate the current publication.
